ANIMAL VICTORY DISASTER AND ABUSE FUND
TERMS OF USE
Effective Date: December 16, 2025
These Terms of Use (“Terms”) govern your access to and use of the website, petitions, donation tools, communications, and services (collectively, the “Platform”) operated by Animal Victory Disaster and Abuse Fund (“AVDAF,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization.
By accessing or using the Platform — including signing petitions, making donations, or submitting information — you agree to be legally bound by these Terms, our Privacy Policy, and any additional policies referenced herein. If you do not agree, do not use the Platform.
1. ABOUT AVDAF
Animal Victory Disaster and Abuse Fund is an independent nonprofit organization dedicated to protecting animals affected by abuse, neglect, cruelty, and natural disasters through emergency aid, relief efforts, advocacy, and public awareness.
AVDAF is not a government agency and does not provide legal, medical, or professional services.
2. PURPOSE OF THE PLATFORM
The Platform exists to:

Raise awareness of animal abuse and disaster-related emergencies

Mobilize public support through petitions and advocacy campaigns

Accept charitable donations to fund animal rescue, medical care, shelter, disaster response, and related charitable activities.

Communicate with supporters about mission-related efforts
Use of the Platform does not create any legal relationship, fiduciary duty, partnership, or obligation of representation between you and AVDAF.
3. ELIGIBILITY
You must be at least 13 years old to use the Platform.
If you are under 18, you must have permission from a parent or legal guardian.
4. DONATIONS
All donations made to AVDAF are voluntary.

Donations are non-refundable, except where required by law or approved at AVDAF’s sole discretion.

Donations support AVDAF’s charitable mission and may be allocated to the area of greatest need within that mission.

Donor designations are honored only if expressly accepted in writing by AVDAF.
AVDAF retains exclusive discretion over the use, allocation, timing, and distribution of donated funds.
Tax Status
AVDAF is a registered 501(c)(3) nonprofit organization. Donations may be tax-deductible to the extent allowed by law. Donors are responsible for retaining receipts and consulting their own tax advisors.
5. PETITIONS AND ADVOCACY
By signing or participating in a petition, you acknowledge that:

Petitions are advocacy tools only

AVDAF cannot guarantee any legal, governmental, or policy outcome

Signing a petition does not create any legal obligation on third parties
-
AVDAF does not control decisions made by courts, prosecutors, agencies, or elected officials
6. USER CONDUCT
You agree not to:

Submit false, misleading, defamatory, or unlawful content

Harass, threaten, or abuse others
-
Impersonate any individual or organization
-
Interfere with the operation or security of the Platform
-
Use the Platform for illegal or unauthorized purposes
AVDAF reserves the right to remove content or restrict access at its sole discretion.
7. INTELLECTUAL PROPERTY
All content on the Platform — including text, petitions, graphics, logos, images, videos, and designs — is owned by AVDAF or licensed to AVDAF and protected by intellectual property laws.
No content may be copied, reproduced, modified, or distributed without prior written permission.
8. NO WARRANTIES
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
AVDAF MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Accuracy or completeness of information

Availability or uninterrupted access

Petition effectiveness or outcomes

Results of advocacy efforts
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVDAF — INCLUDING ITS BOARD MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND VOLUNTEERS — SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

Use of or inability to use the Platform

Petition participation or advocacy outcomes

Donation decisions or allocation of funds

Errors, omissions, or third-party content
-
Data breaches or unauthorized access beyond reasonable safeguards
YOUR SOLE REMEDY IS TO DISCONTINUE USE OF THE PLATFORM.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AVDAF and its Board of Directors, Officers, employees, volunteers, contractors, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to:

Your use or misuse of the Platform

Content you submit

Your violation of these Terms

Your violation of any law or third-party rights
11. THIRD-PARTY SERVICES
The Platform may link to or integrate with third-party tools (payment processors, media platforms, advocacy tools). AVDAF is not responsible for its content, availability, or practices.
12. MODIFICATIONS
AVDAF may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance.
13. GOVERNING LAW
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in North Carolina.

Each organization remains responsible for compliance with applicable laws.
AVDAF does not sell, rent, or trade donor or supporter information as a commercial asset.
In the event of corporate changes involving affiliated entities, any continued use of shared systems will remain subject to this Privacy Policy, donor preferences, and opt-out rights.
